The civil servant, his duties, attestation

A civil servant is an employee who is in the civil service in a certain position. He fulfills the corresponding duties according to the job description.

Duties and responsibilities of civil servants

The duties of civil servants are numerous and determined by their position, but they can be classified as four main groups - professional, general, official and restrictions.

1. A civil servant must ensure compliance with the norms of the Constitution, support the established constitutional order; Faithfully perform the duties defined by his job description; Protect and respect the legitimate interests and rights of citizens; Do not comply with the laws, orders and orders of senior officials.

2. There are certain official and professional duties. The civil servant, according to his duties, must timely consider the applications of citizens, institutions, public associations and organizations, local authorities, and take appropriate decisions in accordance with the established procedure, which is provided for by regional and federal laws. The level of his qualification must be maintained at the proper level in order to perform his duties qualitatively, observe the rules of the labor schedule and work with information for official use.

3. A civil servant must not disclose state secrets and information that relates to the honor, dignity and personal life of citizens. This is a limitation, but a duty at the same time.

4. In accordance with the Constitution, certain categories of civil servants are charged with specific assignments for certain positions, which are determined by appropriate instructions. Civil servants at the same time fulfill civil obligations, which are stipulated in the Constitution (pay taxes and fees, protect state property and natural resources, carry military service, etc.).

The civil servant is fully responsible for his actions. He is obliged to execute the orders of the respective leaders who are given within their authority. At the same time, it is forbidden for a civil servant to perform an illegal assignment. If this happens, he must in writing justify the illegality of the received instruction, referring to the provisions of the legislation, and also receive a written confirmation of the need to execute the instruction.

Certification of civil servants

The civil servant is certified to determine the suitability of the position he holds.

During it, his immediate supervisor provides feedback on the quality of his performance of his duties for this period. The motivated response is supplemented by information on assignments made by a civil servant and prepared documents. Attestation is carried out in three years once.

Sometimes an extraordinary attestation is carried out, in those cases when a decision is made to reduce the number of posts or changes concern the conditions of wages in state bodies.

The civil servant is certified by a specially formed commission.

If a failure to attend an attestation without valid reasons or refuse from it is recorded, he is held accountable for violation of discipline.

The Commission usually takes such decisions:

  • Corresponds to the employee of the replaced position;
  • It is recommended that it be included in the staff reserve to replace a higher vacancy;
  • Does not correspond to the position that it replaces.

The civil servant can appeal the results of the certification.
