Russian Family Legislation: Basic Concepts

Family law defines the legal relations of the parties, limited by family boundaries. It clearly articulates the objectives of legal family regulation and its basic principles.

The objectives of family law in the Russian Federation are:

· Stimulation of strong relationships within the family, based on respect and love, deep responsibility and mutual understanding of each member of the family ;

· Promoting the establishment in the family of such relationships, which are the most favorable atmosphere for the free development of the citizen and for the upbringing of the younger generation.

Family Law: Basic Principles

As the main principles of regulation of relations in the family are called:

1. Equality of both spouses.

2. The conclusion of marriage on the basis of voluntary consent.

3. The resolution of conflicts, disputes within the family by the principle of mutual consent.

4. The priority of family relations is the upbringing and care of children, their well-being and normal development.

5. Ensuring the protection of the interests and rights of minors - family members - as a priority principle of family existence.

Family legislation: the main directions of regulation of relations

The family is not a set of principles and legislative acts, everything is much more complicated and interesting here. However, the family can not do without situations, for the solution of which a certain legislative base is simply necessary, otherwise everything can end as badly as possible for either side. Especially important is a rapid and fair response to intrafamily incidents, when the most sacred - children suffer as a result.

Family law of the Russian Federation first of all establishes the order of the conclusion - divorce. In the area of regulation of the family code, in addition, the following is included:

· The conditions under which the marriage can be considered invalid;

· The consequences of recognizing it as invalid;

· Property relations;

· Personal (non-property) mutual relations of spouses;

· Property and personal relationships between spouses (one of the spouses) and children, other relatives;

· Establishment between spouses of equality in rights and duties with respect to the upbringing of children, their material well-being and education;

· Determining the order of the arrangement of children left without parents in foster families.

Family law on the subject of family law

Under the subject in the family law means social relations between family members, regulated by the rules of family law. The subjects of family law do not include relations based on civil registration: marriage, change of name, adoption or establishment of paternity, birth or death of citizens, restoration, modification or annulment of certain entries in the book of acts is governed by the Federal Law "On Civil Acts State ".

Priority in the family law is the personal (non-property) relationship of the spouses.

Divorce Act

Divorce is a widespread social phenomenon, as a result of which the family breaks down. The procedure for divorce is clearly defined in the Criminal Code of the Russian Federation, it provides for two ways of divorce:

· Simplified procedure through the registry office;

· The judicial system.

Most recently, a new bill was passed that regulates new aspects of divorce proceedings. Most of the changes have touched on the side of the issue in which children take part. For example, if earlier you could not take your child abroad without the consent of the second spouse, and the punishment for violating this rule was not severe, now you can be held criminally liable for this. The maximum limit of the term of imprisonment for concealing the child from the second spouse and preventing their communication (it is now equal to 10 years) is established. From the age of 14 the child has the right to determine with whom he agrees to reside after the parents' divorce. These and other changes can be found in the Federal Law "On Amending Certain Legislative Acts of the Russian Federation".
