LPH: how to arrange? Advantages of a personal part-time farm

In interesting times we live! As economists say, the crisis of 2008 never ended, but only worsened. Our people do not hope for the state, it's time to start a personal subsidiary farm (LPH). How to design this inexhaustible source of family well-being in times of crisis? Will there be a lot of trouble with the documents? Let's figure it out. The question of what LPH is, how to formalize it legally, is relevant to many.

Where to begin?

As a rule, any activity should be planned, especially having a long period of implementation, related to finance (expenses and revenues). The concept of private household plots is described in law No. 112-FZ "On personal subsidiary plots". It indicates that this is a non-entrepreneurial activity. That is, it means that the owner of the economy produces value, and the income from them goes to the family budget, and in-kind. It is necessary to distinguish the personal from the peasant subsidiary farm (CFM). Confusion on this issue leads to improper registration of its activities and, in our case, additional costs. KPH is a kind of entrepreneurial activity, that is, the production of products for the purpose of sale. LPH, in contrast to peasant or farmer, involves providing the family with products and other materials of plant and animal nature. That is, there is no income in financial form.

LPH: how to arrange?

The essence of economic activity greatly simplifies the procedure for its legalization. With LPH do not pay taxes (only for owning land), therefore, most of the controlling bodies bypass them. But in order to start a farm, you need a site. That is, we need to formalize the land under the LPH. At the legislative level, this means that in the hands of the owner or user the land must have the appropriate paper. Ideally, this is a state act. But before it (from scratch) we are still far away. First you need to find out where and to whom the land is distributed. From this point of view, residents of the country are divided into two categories by residence permit. Villagers are given the land. The plots can be located both within the settlement and beyond its borders. But it is much more difficult for the townspeople to acquire land. The law assumes that the desired areas are distributed by the local authorities only in the presence of vacant areas. And this is not always good.

Where to go for the land?

When they decided to acquire a private farm, how to design it is not the most important thing. It is more important to get a site. It should be addressed to local authorities. They are engaged in the use of available space. Write a statement that you want to lead a private household and wait for an answer. Do not consider it a failure. The state is interested in ensuring that citizens themselves solve their material problems. In our country, in principle, it is arranged in such a way that it seeks to reduce the level of expenditures. It is cheaper for a person to give land, but to collect a tax for it, than to pay him benefits so that he does not die of starvation.

When you get a decision to allocate a plot, a new task will arise: to make out the land under the LPH. According to the above-mentioned Federal Law, this is not necessary. The received land can be used for production without informing state bodies. But it's not enough for us, I want to be sure that tomorrow the site will not be taken away.

How to apply for land ownership in a private property?

We came to the most interesting moment for the owners. It's not enough just to get a plot of land, LPH to formalize into property - this is the goal of many citizens. Such an allotment can be transferred to descendants, sold in case of need and so on. The path is not easy, but it is completely understandable.

You have a decree on the allocation of land. Many on this in the past stopped and did not engage in further bureaucracy, now it is necessary to finish, when the "hacienda" has already been overgrown with structures and fruit trees. And you need to go to a special organization that deals with the delineation of the land. Specialists will conduct measurements and issue a passport. It is called land and contains all the data about your allotment.

The next step is to get an order about the established borders. Will give it the same organization. All collected papers should be referred to a cadastre body located in the same region as the land.

State registration is the last step

In the last mentioned organization you will be given a cadastral number and plan. Rather, these documents will add to the already collected package. It will only go through state registration. It is the responsibility of local authorities. Carry the whole package there and write the application. Processing will not take much time. Instead of a lot of papers, you will receive a certificate of state registration of the site. You can rejoice - you managed to formalize the ownership of the property. Of course, I had to run around the authorities, but now no one will take it away.

Additional subtleties and nuances

It is important, from the first step, to ensure that the site is not changed (by mistake). Legally stipulated that land is issued not only for private household plots, but also for gardening, construction and other purposes. Each appointment has its own peculiarities and subtleties. Often people ask: "Where to register the LPH?" - satisfied with the answer that no special papers are needed. But it is not so. Village councils keep a record of smallholdings. They do not have to submit information. That is, the legislator gave the initiative to the owners of the land. This is the nuance that will help us to be friends with the authorities. It is necessary only once a year to go to the village soviet and submit information necessary to this body. "The authorities" will be sure that you are using the land correctly, because with pleasure and willingly go to cooperation, which, incidentally, experts are a lot of trouble.
