Do I need to print a PI?

It is difficult to submit a document with the signature of the director of the company, but without the press. However, it happens ... it happens with individual entrepreneurs. What does the law say about this? Do I need to print a PI?

And the law (civil code, law on IP, other acts) specifies the right of an individual entrepreneur to own a seal. It is the right, not the duty. The power of attorney, internal documents of the organization, tax reporting and other documents have their validity even without a seal, subject to the signature of the individual entrepreneur. You can open a bank account (though not every bank will go for it).

However, everything became not so clear, when this issue got to the Supreme Court of the Russian Federation. There the individual entrepreneur and the association of lawyers appealed with a request to recognize as unauthorized the decision of the administration of his city, which contained a requirement: to have an IP stamp, and its absence meant certain restrictions for the individual entrepreneur in his activities. The court concluded that the essence of business turnover obliges individual entrepreneurs to have a seal, and this is a self-evident norm. But the city administration did not have the right to declare the absence of the press as a violation of the law in its Resolution and, moreover, restrict the rights of individual entrepreneurs.

Let us consider in more detail what the essence of business turnover amounts to. The fact is that there are such documents that provide for the presence of a seal: the management of work books (printing is stamped when dismissed and accepted for work), forms of strict accountability and others.

In addition, partners, suppliers, creditors are unlikely to cooperate with an individual entrepreneur if he does not have a seal. Its absence does not inspire confidence in the firm.

It's quite simple and inexpensive to order an IP stamp (about 400 rubles). It makes no sense to try to avoid these costs. Seals can be automatic, semi-automatic and manual. The most expensive, the price comes to 700 r. - these are the first and, certainly, they are more convenient (aimed, pressed, the seal is ready); The cheapest are the last (150 rubles). Any of these types of seals will last long (only a few years it will be necessary to change the pillow with the paint). If you need a seal with a greater degree of protection against forgery - this, of course, will increase its value.

Judges of the Supreme Court propose to act on this issue by analogy, i.e. To be guided by the requirements for the seal of a legal entity (Law on Societies No. 208, Law on Non-Profit Organizations No. 7 and others). Thus, from separate federal laws it is possible to understand what should be the seal IP: round, with the name in Russian. It can also display an emblem or trademark that allows the company to be identified, i. E. Do not confuse it with any other. When ordering a seal, you can choose the design you like from the ready ones. It is not necessary to verify and coordinate the contents of the press with any authority.

The print can contain the following data: at the bottom of the TIN, OGRN, and in the center the surname, first name and patronymic of the individual entrepreneur, at the top - the address of the company. It can be done differently: in the first external circle, place the address, in the second one - numbers, in the third and last inner circle, the name under which or above which the sign or emblem may be located. It can be an image of an animal, car, branch, emblem of the Russian Federation, letter designation, etc.

Summarizing all that has been said, we note the following. The enterprise can survive for a while without a press, and no one has the right to punish you for this, not even have the right to refuse to register you as an IP! But sooner or later you will get into trouble due to lack of printing. Therefore, it is better to spend a couple of days (for the development of the logo, for manufacturing), but to get the IP stamp and already as a serious representative to conclude contracts, provide reporting, draw up internal documentation, conduct labor books, finally ...
