DNP - what is it? What is the purpose and what are the contributions to the NPD?

In January 2013, Russia issued and approved a law that covers issues of non-profit associations between individuals. It covers in detail the theme of the management of dacha farms, horticultural and other associations. The new document says that there are 3 forms of association between homeowners.

Here, each member takes a direct part in resolving issues relating to the activities, development of the village. The undeniable advantage of the partnership is the fact that its members have the opportunity to independently choose the operating organization. It may be a separate company performing certain types of work, or a number of firms specializing in a specific field.

Appointment

A non-profit non-profit partnership is considered the most convenient form of organization. To prove this, it is necessary to understand what DNP's appointment is. What is this, we will analyze in more detail. The partnership sets itself one main goal - to provide legal and household assistance to all participants of the society. All important decisions here are compulsorily agreed with the members of the association, which excludes the possibility of negative consequences. In addition, the DNP has the right to conduct commercial activities. But here it is important to observe one condition: all profits received from commercial activities should be directed at meeting the needs of a summer non-profit partnership. Associations of this form can acquire, and also exercise property (non-property) rights; Act as a plaintiff, defendant in the courts.

Principle of DNP creation

To create a dacha non-commercial partnership, it is necessary to know the general principles of the establishment of non-profit organizations. First, you should determine the location of the society. At the end of the process of registering the land in the status of the NPD, the necessary allotment is transferred to the citizen at no cost (prescribed in the land legislation). After the project of building DNP is approved, members of the society receive ownership of land ownership. From the moment of payment they become the common property of the members of society. Subsequently, the site can be transferred to individual ownership. When entering the membership of the NPD, participants must pay an entrance fee, which is a payment for land.

Payments

Contributions to the NPC, their amount and the procedure for payment are determined by the Regulation on Contributions, Payments and Funds, the decision of the partnership board, decisions of the general meeting of members of the company. At the time of signing the membership agreement, each participant must make a one-time introductory payment. Its amount is determined by the general meeting of the members of the NPD. It also establishes the size of annual and targeted membership dues, which are paid in equal parts on a quarterly basis on a certain date of the month.

What can you do on the purchased site?

On acquired land plots, members of society may feel themselves full owners. They can be built houses, farm buildings, but do not forget about compliance with the rules and regulations established by law. The DNP documents contain an explanation of such a plan: the acquired land plot should be used for the purposes indicated in the document. It is possible to build only buildings corresponding to the projects of construction (construction) in DNP. In the legislative acts it is said that the owner must master a new site for 3 years.

Responsibilities and responsibilities of members of society

The issues that reveal the essence of the DNP (what is it, its functions, the direction of its activities), the rights and direct responsibilities of its members are enshrined in legislative documents. Among them are the Town-planning Code of the Russian Federation, the Law "On Horticultural, Gardening and Cottage Non-profit Associations of Citizens", the Regulation "On Contributions, Payments and Funds".

Members of the NPD have the right:

  • Elect the management bodies of the association and themselves to be elected;
  • Receive the necessary information on the work of the management and control bodies;
  • Be a full owner on your site according to permitted use;
  • To dispose of the acquired land, if it is not withdrawn from circulation and is not limited in circulation;
  • If the company is liquidated, obtain a legal share of the property that has the status of common use;
  • Appeal to the court to protect their own rights, legitimate interests;
  • To leave the society on a voluntary basis with the simultaneous conclusion of an agreement on the conditions for the use of engineering structures, roads, other property of the association.

Members of the NPD are obliged:

  • Bear subsidiary responsibility for the obligations of the company within the part of the contribution paid;
  • Use the acquired site purposefully, as defined in the membership agreement;
  • Do not cause damage to land and public objects;
  • Do not violate the prescribed rights of members of the partnership;
  • Comply with the requirements of the agrotechnical plan ;
  • Timely make membership, special-purpose contributions;
  • To master your land for 3 years;
  • To participate in events organized by the association;
  • Participate in general meetings of the partnership;
  • Observe established regimes, restrictions and requirements.

Difference between DNP and SNT

Dacha non-commercial partnership is a legal entity created for the purpose of development and further servicing of country type villages. The competence of the society includes issues of construction (maintenance) of roads, protection of the village, garbage disposal and others. In addition, the partnership implements a comprehensive development of the settlement territory. A garden non-profit partnership does not differ much from a summer association. To find out their main differences, it is necessary to determine the area of SNT, DNP, that this concept means in each of the associations. In the horticultural partnership, land is allocated for agriculture and gardening. In the country partnership, in addition to agricultural land, the territory of the existing settlement can be used. In the village of DNP it is supposed to build a dacha type house without fail, with subsequent registration in the property. A SNT pursues the main goal - development on its own garden plot without the obligation to build a house there. The law does not prohibit the registration of either the SNT or the DNP. Two associations also differ in the form of ownership of common property. In a non-commercial partnership, property is considered the joint property of all its members; In partnership, it can be owned by the association as a legal entity. When choosing between partnership and partnership, it is necessary to take into account the agricultural significance of SNT, DNP.
