Criminal record and passport: the features of obtaining a document

What is a criminal record?

A conviction is a condition of a citizen recognized as having been convicted by a court of law of committing a crime if criminal-corrective measures (punishment) have been applied to him. In other words, if a punishment against a person is abolished, it is considered to be undesirable.

A conviction entails certain legal restrictions. This is the prohibition to engage in certain types of activities, and occupy certain positions, and travel abroad. However, even if a person has a criminal record and a passport can not be obtained, do not get upset, because the phenomenon is not permanent: the law provides for a mechanism for repaying criminal records.

Withdrawal and repayment of a criminal record

The repayment of a criminal record is a termination of its validity and cancellation of legal consequences, which is carried out automatically. Different crimes have different terms of repayment relative to the termination of execution of punishment:

  • With a conditional sentence, the conviction is repaid immediately;
  • With punishments (for example, fines) that are softer than deprivation of liberty - after one year;
  • When convicted of crimes of a minor severity - after three years;
  • When committing a serious crime - in six years;
  • If the crime was particularly serious - in 8 years.

Among other things, the criminal record can be extinguished before the expiration of the specified terms in a judicial procedure in the case of impeccable behavior of the convict, and also as a result of amnesty.

It is enough to remove the previous conviction, and the passport can be obtained in the usual way. However, a citizen needs to take a certificate to the police department at the place of residence stating that his criminal record has been withdrawn (repaid).
