Abuse of animals: Article 245 of the Criminal Code of the Russian Federation and regional acts

One of the violations of Russian legislation is mockery of animals. Article for this provides not only administrative, but also criminal liability. Is there an administrative responsibility for cruelty to animals?

Unlike many countries, the article for mockery of animals in the Russian Federation does not provide for liability for the cruelty shown against representatives of the animal world. But the punishment is prescribed in many regional subjects of the country. And cruelty to animals can be considered an administrative offense.

Administrative responsibility in different regions

For example, for inciting one pet to another. In this case, if the affected animal was injured or died, the guilty person may be fined from 4000 to 5000 rubles. A similar responsibility occurs if the pet is injured or died in other circumstances.

In St. Petersburg, there are penalties for people carrying animals or birds in ways that worsen the well-being of animals or birds. An administrative offense also includes actions such as depriving food and water, conducting painful experiments. If the above resulted in injury or death of animals or birds, physical persons are fined up to 5000 rubles, and legal entities - up to 100 thousand rubles.

In Nizhny Novgorod, for mocking animals, the article of the Code of Administrative Offenses has undergone some changes introduced in the summer of 2015. According to them, those guilty of cutting tailings, cutting off ears and removing fangs and claws from animals can be fined if the listed actions were committed without the presence of a veterinarian. At the same time, a fine is imposed on a physical person up to 5000 rubles, and on a legal entity - up to 40 thousand rubles.

In Primorye, there is a law prohibiting mockery of animals. The article says that catching, breeding or killing pets is prohibited for the subsequent use of their body parts (meat, skin, bones, etc.). In addition, the law states that it is not possible to promote aggression against other domestic animals.

In the Kuban there simply exists a law according to which all pets should be officially registered and have a special chip. The pet owner is required to immediately draw up the necessary documents for the animal. Then all these data are entered into the electronic database. But for violation of this law, administrative responsibility is not prescribed.

Criminal liability for animal cruelty

In Russia, the law punishes mockery of animals (article of the Criminal Code of the Russian Federation 245). Most often, it is applied when there is no administrative penalty in the regions . According to the Criminal Code, ill-treatment is punished if:

  • Human actions resulted in injury, injury or death of the animal;
  • There was a hooligan motive, mercenary motives or sadistic methods used;
  • At the time of the massacre the children were present.

It turns out that even if the animal was repeatedly hurt (constant beatings, etc.), a person can not be held criminally liable if his actions did not result in the death or injury of the pet.

First changes in legislation

Therefore, some changes were made to the legislation. In 2009 in the Art. 245 of the Criminal Code of the Russian Federation, part 1. penalties for mockery of animals appeared (the article in the first part provides for liability for one person) in the form of a fine of up to 80 thousand rubles, correctional labor or restriction of freedom for up to one year in both cases. In Art. 245 of the Criminal Code of the Russian Federation, part 2. (for a crime committed by a group of persons) they are charged an amount of up to 300 thousand rubles. Or deprivation of liberty up to two years.

In 2010, the types of punishment remained unchanged, but correctional works in the first part of Article 245 of the Criminal Code were changed for up to 180 hours and added to the second part for up to 240 hours. In 2011, Article 245 of the Criminal Code was again revised. The punishment remained the same in both parts. But the time period in 1 hour has changed - up to 360 hours.

New bills

In recent years, more and more information appears about the livestock, torturing pets and homeless pets. Therefore, the article of the Criminal Code for mockery of animals began to be carefully revised. There are suggested options for bringing to administrative responsibility those who inflict not only physical, but also moral suffering (restriction of movements, deprivation of food and water, etc.) to beasts and birds. Supposed penalties for this for individuals - from 1000 to 3000 rubles., For legal entities - up to half a million.

In 2016, "Fair Russia" proposed:

  • To introduce responsibility for conducting battles involving representatives of wildlife;
  • To make punishment for the bleeding of animals in the Criminal Code of the Russian Federation;
  • Increase the sentence for ill-treatment of pets up to 800 thousand rubles.

Somewhat earlier it was also proposed to introduce amendments to the legislation. For example, to oblige the guilty person to compensate for the therapy and rehabilitation of the mutilated animal. It is supposed to be punished for propaganda of chastity, up to restriction of freedom. And also to toughen the responsibility for the repeated crime, when the mockeries of animals were committed.
