The property right is what should be under maximum state protection. In the legislation of our country it is said that several of its types are recognized: private, municipal, and also other. What was under the USSR? In those days only state property was recognized . In principle, the rest also existed, but under certain circumstances they simply were not quoted. Ownership rights - this is something that fully appeared in the citizens of our country relatively recently.
In modern Russia, it is not so difficult to fully own one's property, since it and the right to it are under the protection of the state. Such an additional guarantee of tranquility allows citizens to practically not use independent measures of protection.
The property right is what allows you to own, use and, of course, dispose of immovable or movable property. All these three components are very important. The mention of them as a general rule should be carried out in that order.
The right of ownership is that the subjects of which are the most legal entities, as well as ordinary citizens whose social position in this case does not matter. Is this the whole list? No, it also includes the Russian Federation, its municipalities, business entities. The property right is what gives the listed a special status. Of course, we are talking about the status of the owner. It can differ in specific cases, but the basis of it will always be absolutely the same.
Today, any property can fall into private property, except for what is separately indicated in the federal legislation (for example, national parks can be called). It should be noted that some restrictions can only be established by law.
Along with the right of ownership of land plots, there is the right of ownership of real estate located on them. This can be attributed to enterprises, and living quarters. The latter are understood as any premises that meet certain standards and are suitable for people living in them. Ordinary city apartments, for example, are in houses belonging to a municipal state. How to make these apartments become the property of those people who live in them for a long time? It is necessary to carry out the privatization process. Every citizen has the right to privatize a dwelling only once in his life. There are also additional restrictions here.
The right of intellectual property is an institution that is still too poorly developed in our country. He is devoted to a whole chapter in the Civil Code, but for violation of intellectual property rights there are still no specific penalties. It should be noted that this term refers to the right to the result of one's own intellectual activity.
