How much money can be obtained by making an alimony in Belarus? This question interests many citizens. Because divorces and refusals to keep a child are found in many countries quite often. As practice shows, it is the first variant of the development of events that becomes the main reason for the assignment of alimony payments. But how can you get them in Belarus? And how much do citizens have in this or that case? It is not so difficult to understand all this as it seems. After all, in respect of payments of alimony, many countries have similar rules. What should I look for?

What is alimony?

Before learning how to get alimony in Belarus, it is necessary to understand what payments are generally made. After all, it is always important to understand what people are asking for and what money. So, alimony is money that is paid for the maintenance of children, needy spouses or disabled parents. Most often, divorces cause the appointment of these payments. The child remains to live with one parent, and the second must give money for its maintenance.

In the first case, they sign a peace treaty in court. It specifies all the nuances of fulfilling maintenance obligations. It can be said that this is a personal arrangement, formalized formally. Calculating the amount

In general, in any case it is necessary to determine the amount of alimony. In Belarus, as in a number of other countries, there are only a few systems that help to solve the task. According to the established rules, alimony can be expressed:

  1. In the form of a fixed amount of money (fixed payments, CBS, Article 94).
  2. Payments in the form of a percentage of the income received (Article 92 of the CoES).

In any case, alimony is paid monthly. And at a certain date. Based on the above rules, the amount of alimony that the second parent will transfer to the child will be calculated. This issue always brings certain problems. After all, people try to reduce payments in various ways.

And if you do not work?

For example, some do not work at all. Then there will be no income! So, it will not be possible to assign monthly payments in various sizes. To quit work in order to free oneself from transferring money for the maintenance of the child is a stupid step. Why?

The fact is that alimony from the unemployed in Belarus and other countries will still be collected. The financial situation does not exempt from responsibility for the maintenance of a minor child. Simply the calculation system will be used in the form of fixed payments. Of course, since a person does not have a profit, he will be offered minimal alimony. But he is obliged to pay them all the same.

How much do people pay?

The CBS provides for specific percentage values that are assigned as maintenance obligations. It does not matter what kind of earnings a citizen has. He will have to monthly transfer money for the maintenance of children, focusing on the following indicators:

  • 25% of the official salary is paid for 1 child.
  • 33% - payments for 2 minors.
  • 50% - if the citizen has 3 or more children.

It is for this reason that citizens are trying with all their might to reduce their official earnings. Depending on him, alimony for a child in Belarus will be assigned. Nevertheless, a certain minimum also takes place. To call a specific figure is very problematic. After all, what affects the amount of payments is constantly changing.

Subsistence minimum for a child

It is a question of that in each country there is a so-called subsistence minimum. It is calculated separately for each category of persons - children, adults, pensioners. This indicator varies annually (and sometimes several times a year). It has a direct effect on the payments under study. Especially if you need to collect alimony from an unemployed person in Belarus (or in other countries, for example, in Russia).

In order to properly assign a monetary amount for the maintenance of the child to a minimum, it is necessary to find out how much the subsistence minimum for a minor is at one time or another. And already from the received data it is necessary to start.

It is known that from August 1, 2016 the following subsistence level budget has been set in Belarus:

  1. For children under the age of 3 years - 112.3 rubles.
  2. Minors 3-6 years old - 155.82 rubles.
  3. For a child aged 6-18, the minimum is 191.5 rubles.

  • 100% of the subsistence minimum per child in the presence of 3 or more minors.

When will higher alimony be assigned? The Republic of Belarus suggests the following alignment: if the citizen resigned no more than 3 months before the appointment of maintenance obligations, the payments will be calculated according to the scheme, similar to that used for calculating the amounts for working spouses.

In other words, if a person has left work recently, 25, 33 or 50% of the earnings he received at the previous job place will be collected from him. But such a system is used only for 3 months after the dismissal. If during this time the citizen does not find a job again, the alimony will be recovered either taking into account the subsistence minimum or from the average earnings in the region where the person lives. Such rules are in force in Belarus to this day.

Reduction of payments

But this is not all that every parent should know. Alimony in Belarus (minimal) can be slightly reduced. Especially if it is an unemployed citizen. There are a number of factors that help to officially reduce penalties for the maintenance of underage children. This practice does not occur very often. But the amount of alimony in Belarus is able to decrease at the discretion of the judiciary, if:

  1. The future payer is disabled. In this case, limiting physical abilities is a mitigating factor. Therefore, the court independently assigns monetary compensation for the maintenance of children, taking into account the standard of living and circumstances pertaining to the life of a citizen. By the way, the privilege extends only to persons with the 1st or 2nd group of disability.
  2. Presence of "new" children. This factor also plays an important role. The interests of minors and their standard of living should not suffer. Therefore, if the citizen has more children, who after the appointment of payments will be in a worse financial situation, the minimum alimony in Belarus will be reduced. How much? It all depends on the circumstances. The exact amount of monthly payments is assigned only by the court.
  3. Any other objective reasons that seem significant to the judicial authorities. It can be anything. For example, the presence of a needy relative, for which the payer carries out care. To reduce alimony obligations, it is recommended to indicate and prove all the circumstances. They must demonstrate the fact that the intended payments will materially harm the standard of living of both the payer and his children (dependents).

All of the above options for the development of events in practice, as already mentioned, are rare. The judiciary always defends the interests of minors. Therefore, even with the unemployed, the court will collect alimony. After all, parents are required to maintain and care for their children. And it does not matter whether there was a divorce. Alimony in Belarus and a number of other countries can be appointed even if there is an official marriage. This practice began to occur more and more often. But the amount of payments from this does not change.

After majority

But that is not all. Not always it is possible to remove from itself alimony obligations after the majority of the child. The fact is that the payment of alimony (Belarus and some countries practice the proposed scenario) will be carried out even after the minor reaches the age of 18. But only under certain circumstances.

We are talking about cases when a child decides to study at a university. While a person has the status of a full-time student of a university or institute, the parent will have to maintain it. So, alimony will still be charged. Such a situation is possible until the child has graduated from the university or has not stopped his studies (for example, because of the deduction). When you re-receive the possibility of receiving financial support from the parents in the form of child support, the person stops.

If voluntarily?

How to file for alimony?

Some are interested in how to file for alimony in Belarus. There are several options: either we are talking about the content in the presence of an officially concluded marriage, or registration of alimony obligations during the divorce process. To implement the idea into life, it is necessary to go to court with a lawsuit. It requires information about the defendant, as well as the plaintiff and all minor children. Also in this document you should indicate the amount that one of the parents requests as alimony. If it is a question of payments in a marriage, it is recommended to justify and confirm somehow the requirements. What documents are required to bring to alimony in Belarus? It:

  1. Claim statement with specific requirements.
  2. The passport of the plaintiff (it is desirable and the respondent, too).
  3. Certificate of the birth of a child (all common children).
  4. The document on the marriage (if any).
  5. Papers confirming divorce (if any).
  6. Information from the workplace of the spouse with the indication of income.
  7. Documents on the composition of the family.
  8. Extracts about benefits received (optional, but desirable).
