Licensing is what?

Basic information

Licensing is a special type of activity in which state bodies are obliged to exercise control over certain types of activity of commercial entities. From this definition, logically follow two questions: why are they required and for what activities? It is in the responses to them that the essence of licensing is contained.

So, what kinds of activities are subject to licensing? As a rule, they are closely connected with such especially important spheres as the life and health of the individual. The most vivid examples here are transportation, health care, training, activities with certain types of metals or gases. But, of course, the list of all licensing objects is determined by the legislation of a particular country based on the priority areas for it. Therefore, the licensing of the activities of entities is the process of monitoring the most important areas. And that explains why state bodies are obliged to carry out such supervision.

Now we need to understand which state bodies are obliged to engage in licensing. In this account, the answer, as a rule, gives directly legislation on licensing. So, for example, Rostroy is obliged to carry out functions of licensing over all subjects that carry out their activities in the field of not only construction itself, but also those organizations and individuals who are engaged in architectural and engineering design. By the way, the types of licensing are determined directly by the object (that is, by the activity that represents the sphere of heightened interest). However, despite the diversity of both species and institutions, the procedure for obtaining licenses has a similar procedure.

The licensing procedure

In fact, the whole process is divided into three important stages: submission of documents, decision making and granting or refusal to issue a license.

Submission of documents is a fundamental step in such a procedure as licensing. This is in fact providing evidence that the declared type of activity will be carried out in accordance with all the requirements that the legislator makes in his official documents. The main list includes:

  • A statement containing not only a request for a license but all the applicant's data;
  • Documents confirming the data specified in the application, namely: copies of constituent or analog documents, acts confirming the ability to carry out the licensed type of activity, a statement on payment of the state fee.

At the stage of consideration of the application and decision-making, only the state body acts. The latter is obliged to verify the reliability of the data and to assess whether the applicant is capable of carrying out a certain type of activity.

The stage of granting or refusing the grant is a special procedure in which the licensing authority gives an official opinion on the results of the examination of the application. If the issue is resolved positively, the applicant receives a document confirming his right to engage in a strictly defined type of activity. If, as a response, refusal represents, then the body is obliged not only to inform about it, but also to justify a negative decision.

Licensing is a special process, the value of which lies in the fact that it imposes a social responsibility not only on the economic entity, but also on the relevant state bodies in especially important areas of the country's life activity.
