On April 2, 2014, President approved Law No. 44. This normative act regulates the procedure and conditions for the participation of the population in ensuring public order. The law is focused on the formation of a clear mechanism for involving citizens in law enforcement.

Relevance of the issue

Prior to the adoption of the law, this sphere was regulated primarily by regional normative acts. At the same time, there were more than 45,000 law enforcement associations in the country, which included more than 450,000 people. For example, in the city squad of Moscow there are about 20,000 people. With their help, more than 60 thousand violations were suppressed, and 313 people were detained on suspicion of criminal activity. The authors of the law expected that its adoption would ensure the involvement of the maximum number of stakeholders in law enforcement . The normative act determines not only the forms of participation of subjects in the protection of order. Its provisions regulate issues relating to the social and legal protection of such citizens.

Forms of participation

Citizens can assist law enforcement agencies. In the framework of this activity, individuals are entitled to report to the police all crimes and threats of their commission. At the invitation of ATS officers, individuals can take direct part in security arrangements. This includes, inter alia, ensuring public safety during cultural, entertainment, sports and other events. Citizens can participate in the search for subjects that are missing.

How to carry out a search, in which places - the persons involved themselves decide. The only requirement, which is established by the law, is that citizens should not create by their actions obstacles to the performance by law enforcement agencies of their functions. Together with these persons, they are obliged to inform the ATS officers about the facts that have become known to them during the search and are important for its continuation. With adequate training, citizens should provide first aid to victims in accidents, poisoning, etc.

In addition, the legislation provides for the possibility for entities to participate in the work of public associations of the relevant (law enforcement) orientation. The decision to form such groups is taken at the general meeting (gathering). Public associations are formed at the place of residence, location of property, work / study without the creation of a legal entity. On their formation, citizens are required to inform the local government and the territorial subdivision of the Ministry of Internal Affairs.

In addition to assisting law enforcement officers in safeguarding order, participating in the identification and suppression of criminal acts, citizens can carry out explanatory work. Specificity

Before becoming a freelance police officer, it is necessary to undergo appropriate instruction and medical examination. When engaging in law enforcement activities, restrictions on service in the ATS are taken into account. Freelance police officers do not have the status of officials. They perform tasks under the direct supervision of an employee assigned to them in the established order. A corresponding document is issued to the persons. The sample of the certificate of a freelance police officer contains the name of the subject and indicates its status. It should have the signature of the head of the unit and the stamp.

How to become a freelancer? To be attracted to law enforcement activities, the subject must provide:

1. Statement addressed to the head of the police department. It specifies directly the request for consideration of the issue of enrolling as a freelance police officer.
2. Consent to the processing of personal data.

5. Instances of completed pages of an identity document.

Rules for the selection of persons

The selection of candidates for non-staff members of the police is carried out by employees of the central departments of the Ministry of Internal Affairs, territorial bodies, organizations formed to exercise authority and perform tasks assigned to the structures of law and order. The business and personal qualities of individuals are studied and tested. Its results are documented by the report of the responsible employee. The document indicates the conclusion about the possibility / impossibility of enrolling a subject in freelance police officers.

Approval of candidacy

The documents listed above are provided to employees who carried out the examination and verification of information to the head of the police department. The head takes a decision on the possibility of enrolling a person in freelance police. When the applications are satisfied, the materials are sent to the Personnel Department to prepare the draft of the corresponding order. The order must specify the employee who will coordinate the work of the freelancer. At transfer, dismissal or occurrence of other circumstances the employee can be replaced by other responsible person.

Identity card

It is issued for signature after the approval of the enrollment order. The documents that serve as the basis for issuing the certificate are kept in accordance with established rules. The account of the issued forms is carried out in the register of registration. Executed by freelancers, citizens are required to ensure the safety of documents provided to them. In the event of damage to the form, expiration of the term or when the personal data of a person is changed, it must be replaced.

Exemption from duties

Powers of a freelance police officer may be terminated:

1. On the initiative of the subject on the basis of the application.
2. When he commits a misdemeanor, defaming dignity, the honor of a freelancer. They, including, will be considered the use of the issued document for mercenary purposes, failure to perform or improper fulfillment of orders received from the responsible employee attached to him.
3. If you receive reliable information about:

• Institution of criminal proceedings against a person;
• Bringing to administrative responsibility for infringement on the order of management or safety in a society;
• The withdrawal of a person from Russian citizenship, the acquisition / possession of citizenship of another country;
• The provision of deliberately false data when enrolling in the ATS.

The termination of powers is formalized by the corresponding order of the head of the department of internal affairs. The issued document is then withdrawn for subsequent destruction in the manner established by the personnel department. The card for the retired employee is to be kept for 3 years. At the end of this period, it is destroyed.

Responsibilities of the responsible employee

Freelance police officers, whose organization of work is carried out by coordinating officials, are obliged to fulfill conscientiously the orders received. The responsible employee at the same time:

1. Gives specific tasks, instructs the subject on the ways of their implementation, provides control over the execution.
2. Participates in conducting training sessions on methods and forms of law enforcement and prevention of offenses.
3. Raises the legal literacy of the controlled person.
4. Spreads the positive experience of the work of freelancers, introduces to the leadership of the ATS the proposals for its improvement.

Prohibitions

The responsible employee has no right to:

1. Instruct the subject to carry out independent investigative and operational-search activities. The unauthorized participation of freelancers in the specified activity is not allowed. The responsible employee also can not entrust the person to independently fill out the protocols on administrative violations, check the received applications and reports on crimes and misdemeanors.
2. Involve the subject in undertaking activities that are known to involve a risk to his / her health / life.
3. Provide a freelancer for acquaintance materials in which there is information classified as state secrets, and other information with limited access.

Efficiency mark

The effectiveness of the work of freelancers is analyzed at least once a year. The results of the study of effectiveness are documented by a report. He is an employee, coordinating the activity of a freelancer attached to him. The responsible officer is obliged to report to the head of the department of internal affairs about the carried out check. At the same time, the employee presents his conclusions about the expediency of continuing cooperation with the citizen. For the shown activity, increase of prestige of law enforcement bodies persons can be encouraged. The expression of gratitude is formalized by the corresponding orders of the head of the division.

Legal Possibilities

The rights of a freelance police officer have a number of limitations. When executing assignments and tasks, individuals can not make their own decisions.
