What are the documents for disability? Obtaining a disability: description of the procedure

Every year the number of people unable to lead a full-fledged life increases. Dysfunctions of the body due to diseases, traumatization or birth defects, which caused the limitation of life, the need for social protection - all this gives a person a "disabled" status. Confirmation of the patient's condition is carried out by the medical and social expert commission (MCEC). Documents on disability, which are examined by the representatives of the commission, assure the person's right to disability.

What is disability?

The condition in which a person is not able to carry out a mental, mental or physical activity to the full is called disability. This term is used not only in the medical field, but also in the legal sphere, because the establishment of a patient's disability is carried out by special bodies in accordance with the law.

The medical and social expert commission is engaged in determining the state of a person. The procedure called disability is based on the evaluation of the following criteria:

  • Type of impaired function in the human body;
  • Degree of severity of the disorder;
  • A class of ability to live of the person;
  • Degree of limitation of the class of life;
  • Criteria for disability and disability groups.

List of diseases that give the right to apply to the Ministry of Health

One opinion of the patient about the fact that he needs a disability is not enough. There is a certain list of pathological conditions, on the basis of which the commission determines the status of the patient. Generalized groups of persistent changes in the functionality of the body include:

  • Psychosomatic functions;
  • Speech and language functions;
  • Functionality of sense organs;
  • Motor functions;
  • State of metabolism;
  • Internal secretion;
  • Functions of hematopoiesis and cardiovascular system;
  • Work of respiratory, digestive and excretory systems;
  • The state of the immune system;
  • Birth defects (if any).

These violations are manifested to a greater or lesser extent. The fluctuations in the indicators of changes in functionality range from minor to pronounced.

Classes of life

Getting a disability requires assessing the life of a person and the degree of change, taking into account the biological age of the patient. When disability is given, the following indicators are determined:

  1. Evaluation of the ability to self-service includes determining how much time a person spends daily on everyday household affairs without resorting to outside help. It can range from partial use of ancillary equipment to total dependence on outside help.
  2. The analysis of the ability to move independently takes into account the partial need for additional technical structures or complete dependence on outsiders.
  3. Indicators of the ability to navigate in space, terrain, and their own thoughts range from independence to absolute incapacity for such orientation and the need for assistance from third parties.
  4. Assessment of the ability to communicate is based on the determination of the need to use technical means or nonverbal factors of language speech.
  5. The ability to control behavior ranges from partial self-correction of behavioral reactions to the absolute impossibility of independently responding to it.
  6. Analysis of the ability to learn includes the possibility of attending general educational or specialized educational institutions, as well as the lack of opportunities for independent learning.
  7. Assessment of the ability to work is based on determining the conditions necessary for the work process of a particular patient, the intensity of the load, the volume of tasks performed. In the opposite case, it is confirmed that it is impossible to work independently.

Groups of disability

In the case when they give the status of a disabled person to a minor patient, his category is called "disabled child". Persons over 18 years of age are divided into 3 main groups. The first group of disability is given to a person in the following cases:

  • There is a pronounced impairment of the functions of the organism of a persistent nature;
  • The existence of criteria for absolute inability for one or more classes of life;
  • The patient needs social care and rehabilitation.

The second group is assigned to persons who meet the following criteria:

  • There is a pronounced impairment of the body's functions of a persistent nature;
  • The presence of intermediate criteria of inability for one or several classes of life;
  • A person needs social protection and recovery after illness.

The third group of disability is based on the following indicators, which are taken into account by the medical and social expert commission:

  • A moderate disruption of body functions;
  • Presence of initial criteria of inability for one class of vital activity;
  • Requires social protection and rehabilitation.

Term of disability appointment

Persons who received 1 group of incapacity for work, to submit documents to the Ministry of Justice for disability next time is necessary in 2 years. Representatives of the remaining groups are reviewed annually. "Child-invalid" is issued for 1, 2 years or until reaching adulthood.

Indefinite incapacity for work

Set lifelong (perpetual) disability can be based on the presence of malignant or benign tumorous processes, incurable diseases of the nervous system, mental pathologies, irreversible changes in the brain, progressive systemic diseases, limb defects, the presence of deafness and blindness.

The following groups of the population have the right to form an indefinite disability:

  • Men over 60 and women after 55 years (regardless of group);
  • Men who must undergo the next revision after the age of 60 (regardless of the group);
  • Women who turn 55 before the next re-registration (regardless of the group);
  • Servicemen who received injuries, wounds and defects during the period of service (regardless of the group).

Documentation

The treatment-and-prophylactic institution, the pension authority or the social protection department issues a referral to the commission. Hospital and polyclinic draw up such a document only after diagnosing the disease, carrying out treatment and rehabilitation. The directions that the other organs give out must be confirmed by the appropriate directions of the health facility.

Refusal to give a person a referral to the MCEC should be documented so that the patient can independently apply to the bureau.

The list of documents that are mandatory for determining the working capacity of a particular person:

  • Copy of passport or birth certificate (depends on age);
  • In the case of a representative of the patient - a document confirming his person;
  • A statement with the stated purpose of conducting the examination;
  • Referral to the Ministry of Health and Social Development issued by the health facility or other authority;
  • Medical card;
  • A copy of the work record book ;
  • Documents on the education received;
  • Production or pedagogical characteristics;
  • When you re-apply, a certificate of disability;
  • Individual rehabilitation card;
  • Other documents upon request.

A copy of the passport must be confirmed by the original document. A copy of the work record card should be assured in the personnel department where the patient is working. The medical card should include extracts about in-patient treatment, the results of examinations, analyzes, X-ray pictures. Previous inspections of specialists should be officially certified by seals and signatures. In the presence of pathology on the part of the musculoskeletal system, it is necessary to describe the X-ray image taken immediately before contacting the Ministry of Health.

Course of the examination

The examination is carried out in the bureau located territorially in the place of residence or registration of the applicant. The establishment of the disability group is confirmed by an appropriate certificate issued by the commission with signatures and seals. An individual rehabilitation card is also filled in, where the following data are indicated:

  • Duration of disability appointment;
  • Passport data;
  • The intensity and volume of the recommended work regime;
  • The period of necessary treatment in the hospital for the rehabilitation period;
  • Consultation of specialists before the next re-examination.

Composition of the IEC

The general commission includes a therapist, surgeon, neurologist, representative of the social protection body, representative of the trade union and registrar.

The commission, which has a narrow focus, consists of two specialists in the specialization profile, a doctor of related specialization, representatives of social protection and the trade union and registrar.

  • ophthalmology;
  • Cardiorheumatology;
  • oncology;
  • traumatology;
  • Occupational pathology.

Denial of disability

In the event that a citizen has not been found incapacitated, he is given a certificate fixing the decision. With this document, the applicant can apply to a higher-level bureau to review his question.

For the appeal, all the same documents are submitted, adding to them a denial of disability and a personal application. This must be done within a month after receiving the first decision of the commission. The matter is considered and a decision is made no later than 30 days after the date of submission of the application for appeal.

Conclusion

The decision of the commission is mandatory and requires the fulfillment of the obligations of public services to the applicant. It can be appealed in a court order on the basis of instructions established by law.
