The status of a foreign citizen who allows him to legally reside on the territory of the Russian Federation for 5 years, as well as freely cross the borders of that country at any time and on any lines is called a residence permit in the Russian Federation (residence permit). This document can be issued to a stateless person, in this case the residence permit also acts as an identity card.

The Federal Law "On the Legal Status of Foreign Citizens in the Russian Federation" of July 25, 2002 No. 115 is the main regulatory legal basis for this status. The law defines the grounds for issuing residence permit and the grounds for refusal, the procedure for registration is also described. There are other legal documents that determine which authorities are responsible for this issue, what documentation is required to obtain the status, what terms, etc.

In addition, the above-mentioned law determines the relationship between foreign citizens and state authorities, local self-government bodies, officials of these bodies, which arises as a result of finding a foreigner in the Russian Federation and carrying out any kind of activity.

The main condition for obtaining residence permit is the residence of a foreign citizen in the territory of the Russian Federation for 1 year with a temporary residence permit (RWP). RVP - this is also the status of an alien, providing him with certain legal rights and being the previous step towards obtaining a residence permit. It is noteworthy: the law provides for cases in which it is possible to obtain a residence permit without a RWP. These are foreign highly qualified specialists invited to the Russian Federation for work, as well as citizens of the Republic of Belarus.

Differences of the RWP from the residence permit are significant and are reduced not only to the list of rights acquired with the status. The presence of a residence permit gives an opportunity to obtain Russian citizenship; After the expiry of this status, a foreign citizen can apply for its renewal, and the number of such renewals is unlimited. As previously stipulated, with such status, a foreigner can freely leave the Russian Federation and return back, even as a citizen of the country with which the Russian Federation supports the visa regime. And another important difference: the residence permit gives the right to carry out labor, entrepreneurial and other activities without additional registration for this permission.

Temporary residence in Russia does not provide the above privileges, although it provides the foreigner with a certain legal status.

In order to obtain the status of a Residence Permit, a foreign citizen must submit an application for a residence permit to the territorial office of the Federal Migration Service of Russia no later than 6 months before the expiration of the temporary residence status. The application shall be submitted in two copies, strictly executed in accordance with the rules of the Administrative Regulations. In addition, a foreigner can send an electronic application through information and telecommunications networks of general use.
