Privatization of housing: the pros and cons

One of the most popular topics recently, of course, is the privatization of housing. This is a responsible question, and therefore it is important to approach it with knowledge and various nuances.

First, let's see what the privatization of housing implies. Speaking in legal language, this is the process of transforming property from state to private. What does this give us? Much, and it is possible to allocate both pluses, and minuses. Let's start with the positive sides.

  • Since the wages of most of the population of our country is very small, and the prices of apartments, on the contrary, are large, the question arises of how to buy your own housing with minimal financial costs. Privatization of housing will make it possible to make a personal apartment from a state apartment.
  • It ensures the human right not only for personal possession, but also for use. What does it mean? And the fact that now you can freely sell an apartment, change, give, and also carry out other legal actions, that is, dispose of your property.
  • Separately, it should be noted that the list of opportunities for the owner of housing includes the right to redevelopment at its discretion (but forget about the provisions of Russian legislation on this issue is also not worth it).
  • In addition, the apartment can now serve as collateral for obtaining a mortgage loan.
  • Privatization of housing gives some guarantees to the owner. For example, if he does not want to pay for repairs, as well as house maintenance, no one has the right to evict him from the apartment.

Now about the minuses.

  • More recently, it was possible to carry out this process without worrying about the financial side of the issue. However, the Federal Law declared the cessation of free privatization from the spring of 2013. In addition, every year you need to pay a special tax.
  • The law on privatization of housing implies a slightly higher rent.
  • If the public housing in an emergency condition can later be replaced by a larger area, then this law does not apply to privatized apartments: realtors will proceed from the norm of the area laid to citizens (and equal to 18 m 2 ).

Privatization of housing. Documents you need

  • Passport data of all those who are registered in the apartment (copies of the birth certificate will be required from minors ) ;
  • Copies of documents that indicate the right to privatize one or more citizens, and, accordingly, a certificate of non-participation in privatization, as well as a notarized written refusal of an adult member of the family;
  • Copies of death certificates of citizens residing in the apartment;
  • Originals of documents for the apartment;
  • A certificate of re-planning, if it had a place to be;
  • An extract from the home book, which contains information on all places of residence since 1991 (if any);
  • Copies of receipts reporting payment by residents of utilities for the past three months.

To privatize housing or not is a private matter for everyone. However, most lawyers support this action.
