Failure to pay an administrative fine at the due date entails what sanctions? Responsibility for non-payment of a fine in due time

A fine is a form of punishment in administrative law. It is a monetary deduction in respect of a legal, official or physical person who has committed a misconduct.

Penalty in administrative law is the most applicable measure of coercive influence. It is a recovery of property. Can only be used as the main punishment. A special part of the Administrative Code assumes an administrative fine as sanctions in almost all articles.

The offender, to whom the penalty is applied, is obliged to pay the recovered amount in the period determined by law. Failure to pay an administrative fine within the prescribed period entails application of sanctions.

Functions of fine in administrative law

A fine performs several functions simultaneously: preventive, punitive and compensatory.

1. The preventive function is aimed at preventing violations in administrative law in the future.

2. Punitive function is focused on the punishment of the offender for administrative action by applying to him the penalty.

3. Compensation (legal) is aimed at restoring property rights and rights violated by illegal means.

Not always functions aimed at further prevention of the offense, perform their work. Sometimes there is such a fact as failure to pay an administrative fine on time. The prescribed term is determined by the legislature. Having increased for any reason this period, the citizen will still have to pay the specified amount in the future. As practice has shown, there is no point in avoiding punishment. To harm such actions can only be imagined.

Terms of payment of a fine

The period allocated for payment of recovery by the person brought to justice is sixty days. During this time, the offender is obliged to part with the assigned amount, since non-payment of an administrative fine within a specified period entails application of certain sanctions. Previously, the allotted period was thirty days.

It is important to remember that the offender has the right to appeal within ten days or appeal against the decision on an administrative fine. At the end of this period, the citizen is obliged to pay the recovered amount. Without taking any action to appeal or protested the protocol, the offender agrees with the charge and this type of punishment. What will happen if a citizen who has committed an administrative offense does not pay a fine? The law for this presupposes responsibility. For non-payment of a fine within a specified time, sanctions may be applied. For example, they can be expressed in increasing the amount of penalty, as well as other types of punishment.

The amount of the fine

Penalty for administrative misconduct for individuals is set at a rate not exceeding five thousand rubles. In exceptional cases, it can reach several hundred thousand rubles. Officials shall pay the recoverable amount, the amount of which may be from fifty thousand to one million rubles. Legal entities may impose a fine of up to sixty million rubles.

The penalty can not be less than one hundred rubles, and for traffic offenses the fine is a minimum of five hundred rubles.

The exception is made by citizens to whom the fine is not applicable: to military conscripts and student cadets before the expiration of the contract.

What threatens for non-payment of an administrative fine?

In practice, it often happens that persons who are obliged to pay the recovered amount are maliciously evading this penalty. In order to prevent this situation, preconditions have been created to ensure the voluntary and timely fulfillment by the offenders of the obligation to pay a fine. After all, some citizens do not think about the questions: "What can I not pay the fine? What consequences does this lead to punishment? "

The Code of Administrative Offenses in Article 20.25 provides for certain sanctions for evading administrative punishment. So it's better not to test fate. Failure to pay an administrative fine within the prescribed time limit entails the imposition of another penalty. What does it mean? Such a penalty is paid in double amount from the amount that was not paid in a timely manner. This penalty for administrative offenses can not be less than one thousand rubles. And also failure to pay a fine entails additional administrative penalties, for example, in the form of arrest. The term of this preventive measure is no more than fifteen days. Or this behavior leads to the fact that the citizen is awarded work at any state facility. The term of this punishment is not more than fifty hours.

Punishment for avoiding sanction for failure to pay a fine

To citizens evading the payment of a fine, one of the above penalties applies. However, this does not frighten everyone. The law tells about administrative fines and responsibility for non-payment of a fine. However, the offender can also be neglected in the performance of these duties. Consequently, this attitude towards punishment entails additional measures provided for by administrative norms. For non-fulfillment or evasion from repayment of the sum appointed repeatedly, a more severe punishment is provided. But the recovery is becoming more severe. For example, for the abandonment by the offender of the place where he is serving an administrative arrest, or for avoiding serving his sentence, imprisonment follows. The law allows for punishment of a malicious defaulter with imprisonment for up to fifty days. Or increase the period allocated to compulsory work, up to fifty hours.

Due to the fact that non-payment of an administrative fine within a specified period entails mandatory work as punishment, a person evading their performance risks to aggravate the situation. Such behavior may lead to an increase in the amount of recovery, an administrative fine sometimes reaches three hundred thousand rubles. Or the offender is threatened with arrest for up to fifty days.

In conclusion, I would like to say that avoiding the imposed penalties is unprofitable for the offender himself. Sooner or later you will have to pay the bills, but the punishment will be more severe. Better not bring to this.
