Responsibility for drinking alcohol in public places

Responsibility for drinking alcohol in public places ... This topic has become quite relevant recently. And it is right. Agree that it is rather unpleasant to observe on the street scenes in which not quite sober youth (and not only) behaves in an inappropriate way. Insults and defiant behavior are just a small part of the consequences of alcohol, which, by the way, is a popular drink.

Punishment in accordance with the Code of Administrative Offenses of the Russian Federation

In Russia, drinking alcohol in public places in the presence of a large number of people is punishable in accordance with the provisions of administrative law. Any citizen of Russia is punished if he allows the use of alcohol-containing products in places where people are crowded. This applies to beer and other types of alcohol. Please note that if this offense is committed by a minor, then the responsibility for his actions will be borne by his parents or guardian.

What about alcoholic beverages?

As for alcohol itself, all drinks containing more than 12% of alcohol are included in the list of banned for consumption in public places. Punishment provides for the imposition of a fine. Exceptions are such public places as cafes, restaurants and so on. The consumption of alcohol-containing beverages on their territory is not a violation of the law.

What places are considered public?

Administrative responsibility is exerted on citizens of the Russian Federation who are seen drinking beer and other alcohol-containing drinks in a public place. The prohibition of drinking of alcoholic beverages applies only to some of their types:

  • Various medical institutions (hospitals, polyclinics, etc.);
  • Educational and children's institutions;
  • City transport (suburban including);
  • Objects of sports use (sites and others);
  • Pavilions of stops and gas stations;
  • Places designated for cultural recreation (parks, cinemas, beaches, etc.);
  • Airport, railway station and others, implying the accumulation of a large number of people.

Responsibility of an administrative nature extends only to persons who are already sixteen years old. For the drinking of alcohol by minors, the punishment is borne by the parents, if any, or by the guardian.

The size of the fine

The Code regulating the scope of administrative violations in the Russian Federation, as punishment for drinking alcohol in public places provides for the collection of fines, the amount of which can be from a minimum of 100 to a maximum of 1,000 rubles.

Note that the imposition of punishment is made even if a citizen in alcoholic intoxication was detained in the street, despite the fact that he used alcohol-containing drinks, for example, in a cafe or restaurant.

Those violators who have not reached the age of sixteen will also have to bear responsibility. It will be expressed that it will be necessary for their parents or guardians to pay a fine for drinking alcohol.

Trial

In case of denial and refusal to perform the imposed punishment, the offender is brought to trial in court. For such judicial consideration, the plaintiff should submit an application to the judicial authority. As a plaintiff can act either a witness of the incident, or, so to speak, affected by the actions and behavior of a citizen in alcoholic intoxication. After the case is considered in the court session and the judge makes a decision, its execution is transferred to the bailiff service. Such a trial can be conducted both in relation to an adult citizen, and to a minor. It is possible to avoid punishment if your lawyer has sufficient experience and knowledge to help convince the court that the evidence of the defendant's fault is insufficient.

Who else faces punishment for drinking alcohol?

If the age of violators is less than 18 years, then other sanctions may be applied. For example, in addition to punishment of parents (guardians) in the form of a fine, the responsibility is borne by adult partners of drinking alcohol. On persons who contributed to bringing minors to the state of intoxication, also acts of the Code of Administrative Offenses, or rather his separate article. Drinking alcoholic beverages is fraught with penalty for adults who consume alcohol in the form of a fine, which is set at a minimum amount of 100 and a maximum of 500 rubles. The exact amount of the fine depends on the degree of alcohol production.

News of legislation

According to the legislative act, effective from January 1, 2013, drinking of alcoholic beverages in public places is prohibited. Penalties for the offense are penalties.

If we talk about what belongs to a public place, then their list is significantly increased in the new legislation. It included educational and medical organizations, various cultural institutions, sports facilities, all public transport and stop pavilions, various markets, beaches and railway stations, as well as courtyards, entrances and even staircases. The size of the fine, as already noted above, varies from 100 to 700 rubles, depending on the degree of drink used.

Still it is possible to note the amendments that have come into force to the current legislation. They provide a period of time in which you can sell strong alcohol products (over 15 degrees) and beer. This time interval is limited in the evening, from 22.00 to 9.00 am. And these same amendments set a ban on the sale of alcohol products in pavilions and kiosks. For institutions belonging to the category of public catering, the law on drinking alcohol is not applicable.

Penalties have also become more stringent. For example, this applies to sellers of alcohol products, which distribute it to minors. The penalty for such an offense is now 10 times greater than before, and for an individual it will vary from 30 to 50 thousand rubles, and for the official will already be at least 100 and a maximum of 200 thousand rubles. The highest penalty is imposed on a legal entity and amounts to an initial amount of 300 and a maximum of 500 thousand rubles. It is interesting that in this case all available alcoholic beverages are confiscated.

conclusions

So, let's sum up. It became clear that any citizen in Russia can be punished in the form of a fine for drinking alcohol in public places. But that is not all. Not only the use, but also the finding in a public place in a state of intoxication falls under the action of the Code that regulates the sphere of administrative offenses. For minors, their parents or, in the absence of such, guardians are subjected to punishment. Fines may amount to 1000 rubles, and may also be recovered as a result of a trial. And yet, accomplices in the use of alcohol with minors are also responsible for their actions and are punished in the form of a fine.
