Judicial construction and technical expertise as is

Real estate in our country is, perhaps, the most painful issue for all citizens. This applies to its receipt or purchase, and to its condition, and to its maintenance. It is very difficult sometimes to prove to the higher ranks that the house should be demolished in the very near future, until the irreparable happened. But even the failing floor, the crumbling walls and the leaking roof for them are not grounds for taking any measures.

How to be? There is for such cases judicial construction and technical expertise, which is defined as factual data, the circumstances of a civil or criminal case, which are subject to establishment through special knowledge.

What are the tasks and subtasks of the SSTE?

The forensic experts are faced with a task that they should solve, but sometimes these tasks are unsolvable, in particular:

An incorrectly posed question. It depends on the professional competence of the person who appointed the examination;

- the formulation of the question, which can not be answered due to the lack of a method of solution.

The name "judicial construction and technical expertise" includes such a concept as a poor-quality object. What is it?

- a sample of the building structure presented to the expert after the destroyed building, without indicating the place of his selection;

- Examination of the estimate documentation in the absence of the tasks of design and estimate documents necessary for the expert's decision.

To solve the set tasks, the expert sometimes needs to know the reasons that can be attributed to additional materials:

- weather;

- Wind power.

Unfortunately, the bodies that assign expertise do not always take into account the above factors, which allow more accurate answer to the tasks assigned to the expert.

It turns out that the expertise of construction is a solution to the system of tasks, consisting of one general and a chain of private ones. Of course, the general task is put before the expert by the authorities or the court, but private ones are already expert on their own, and as such they are not involved in the evidential process.

Judicial construction and technical expertise is divided into several groups by tasks:

- cost;

- converter;

- normativistic;

- causal;

- diagnostic;

- classification.

In general, the examination finds a solution to the questions about:

- ownership of construction products , building structures, materials, products;

- performance of construction works by a certain class, genus, species, type, group composition;

- the cost of construction and completed works or the price of the property of the town-planning, housing, industrial spheres;

- compliance of normative and technical data of construction products and production of materials, parts, products, structures;

- causes, conditions, circumstances and mechanism of accidents and accidents in the construction sector.

Naturally, this is far from a complete list of tasks and subtasks, but this is a judicial construction and technical expertise from within.
