Municipal service and municipal office: description, features and functions

Each Russian city has its own local government. That's where the municipal employees are. What exactly is a municipal service? This will be discussed in this article.

"Municipal service" - what is it?

Municipal service is carried out in local self-government bodies, and more specifically, in the apparatus of executive or representative bodies. Any municipal post has several subspecies.

It is worth highlighting the main features of the work in question. These include:

  • Publicity. This is one of the main and most famous signs of service in municipal bodies. Everyone is able at any time to observe the work of the employees in question.
  • Policy replacement of municipal service posts that are not elective.
  • Subordination to the municipality.
  • The activities are carried out on an ongoing basis.

Provision on municipal office

Any municipal post is based on the so-called provision on municipal posts (more precisely - "Regulations on municipal service"). It is in this document that all the key points necessary for the quality implementation of work activity are prescribed. Here the following principles are fixed:

  • In the priority of the rights and freedoms of man and citizen;
  • All citizens of the Russian Federation have absolutely equal access to the service, which is municipal;
  • The concepts of stability, professionalism, accessibility, competence and non-partisanship are consolidated;
  • Legal protection of all employees in municipal bodies is guaranteed.

Thus, the provision on municipal posts contains all the basic working moments. They are quite sufficient for competent and high-quality implementation of their working functions by the employees in question.

On the social functions of the municipal service

To build a more holistic picture of the municipal service is impossible without telling about its basic social functions. The following can be selected here:

  • Constant support of the layers and groups of the population considered socially unprotected in the society;
  • Timely implementation of social forecasting;
  • Work to remove any form of tension in society;
  • Work to maintain stability in various public spheres;

The basis of the municipal service is based on a very important principle: the employee in the sphere in question replaces municipal posts that are not elective. At the same time, all available positions are divided into those that:

  • Replaced by the decision of the elected body of local self-government in respect of employees elected to this body by election;
  • By municipal elections.

It is worth mentioning about another qualification. So, all municipal positions are divided into:

  • Leading;

What is forbidden to a municipal employee?

Municipal office has always been considered incredibly complex, difficult, and therefore very responsible. Therefore, there are a number of prohibitions for people who work in the sphere in question. What are these prohibitions? A municipal employee is prohibited from:

  • To conduct any form of entrepreneurial activity;
  • Act on behalf of third parties in local government bodies;
  • To accept, while in the official position, various gifts or fees from any natural or legal persons;
  • Use state property, carry out various actions with him (except for cases related to the performance of official duties);
  • To disclose to the outsiders official secrets, valuable working information, etc .;
  • Public workplace assessments, statements, judgments, and so on.

From the above points it becomes clear that the municipal employee must be honest, hardworking and very calm person. That is why not everyone can work in the sphere in question.

Duties of the municipal employee

All of them are registered in a special labor situation. Here are just some of the most basic responsibilities of the representatives of the sphere in question:

  • Conscientious and qualitative execution of all necessary functions;
  • Ensuring an absolutely impartial and equal treatment of any natural or legal person; Conflict-free and balanced in various ways;
  • Observance of not personal interests, but of the interests of the organization;
  • Manifestation of correctness and respect in dealing with any persons;
  • The display of respect and tolerance for the traditions, customs and cultural elements of the peoples of Russia;
  • Prevention of conflict situations, mandatory measures to eliminate them.

The positions of municipal employees are very diverse. Each representative of the sphere in question is endowed with a number of individual functions. However, all the duties presented above apply to all persons involved in the sphere of municipal government.

On the rights of a municipal employee

Any working person has a number of professional rights. Not exception are people working in municipal bodies. What are the rights of people occupying municipal public offices? The special provision referred to above prescribes that the persons in question have the right:

  • To get acquainted with any kinds of documentation that somehow regulate the work, rights and responsibilities of the employees in question;
  • On a timely, corresponding to all norms of payment of labor;
  • To ensure comfortable working conditions (according to Labor legislation and other regulatory legal acts);
  • For full paid rest;
  • To receive all necessary information, documentation or other elements necessary for the quality of work;
  • To improve working skills;
  • The creation of trade unions;
  • On social guarantees.

Thus, the rights of municipal employees are practically no different from those of ordinary workers. In fact, the representatives of the sphere in question are the most ordinary workers who work for the benefit of society. They are endowed with the same range of rights as all other working citizens.

On the responsibility of a municipal employee

The rights of municipal employees differ little from the rights of ordinary workers. And what about responsibility? In this case, everything is much more complicated and even more interesting. After all, representatives of the sphere in question bear much more responsibility for all their actions. Everything here depends on the level of qualifications and the powers conferred on the person. An important role played by experience. In general, any post of the municipal formation is not so easy to occupy, and even more so to keep. A simple employee is pressured by both the common people and the authorities. Work in the organs of municipal government is incredibly complex and responsible.
