Land Use and Development Rules in Russia

The rules of land use and development are a document that dictates the procedure for the operation and construction of a land plot. It was drawn up in accordance with the urban zoning. Zoning is the division of the territory of the city into zones and the establishment for them of a uniform for all urban planning regulations. This adjustment has long been used in most cities of Russia. The draft states that these rules of land use and development are created for the sustainable development of cities and in order to improve the environment. It ensures the safety of cultural objects and the rights of residents. A separate project is drawn up for each city.

In St. Petersburg

For example, in St. Petersburg, the authorities had to develop land use and development rules back in 1998, but did not hurry with it. Since the document was not, respectively, there were no rules for town planning. The authorities distributed the land plots at their own discretion. As a result, the city raised the issue of corruption and the rights of the inhabitants began to be infringed upon. In connection with the sealing construction, conflicts began to appear in the city, which eventually acquired a mass character. Residents are still waiting for this document.

Existing shortcomings

The rules of land use and development should give an answer to the question of where you can build a house, and where not. The already existing project is illiterate and does not cover many areas. It does not provide for the rules of construction in the suburbs, historical centers and areas of medium-rise buildings. All laws are extremely laconic and not worked out in detail, all this unties the hands of officials. The most important drawback lies in the fact that the rules of land use and development do not correspond to the General Plan in the city of St. Petersburg. The authors of this document even tried to redo some of the sub-items of the Master Plan. As a result, there is a conflict between these two laws, which contributes to the impossibility of their implementation. Due to poor performance of high-altitude regulations, there are big problems. The existing laws can not even be regarded as a legal document, as it is unambiguously impossible to interpret it. All the rules of land use and development completely contradict the requirements of the Town-planning Code of Russia.

In Moscow

The same situation is in other cities of Russia. The rules of land use and development of Moscow are also in the process of development. The city authorities are working on them and making constant amendments. State Duma deputy Mikhail Moskvin clarified that all previous rules can contribute to the re-consolidation of the entire region. He also added that the new rules for construction and land use will be considered in the coming year. Otherwise, the issuance of town planning documentation will be suspended. If such a situation has developed in the largest cities of Russia, then what about small ones? We can conclude that the rules of land use and development are not regulated throughout the country, and this threatens unnecessary re-consolidation of the entire territory.
